The Spanish Notary plays a professional role in a wide range of acts and legal transactions, either because the law exceptionally requires them to be formalized in a public deed, as in the case of the incorporation of companies, or, generally, because the law attributes very important effects to the notarial document, given the necessary impartiality, legal expertise, and the public official status of all Notaries.
Thus, the notarial document is enforceable, serves as conclusive evidence of the date and fact of its execution, guarantees the identity and full legal capacity of the individuals who sign it, and confirms that it was made freely and voluntarily. For this reason, it is a particularly qualified document and, as such, is subject to registration in the Commercial Register or the Property Register, depending on the case.
